Galerie Maeght Sanctioned for Anti-Money Laundering Failures
The French National Sanctions Commission (CNS) has imposed a heavy fine on Galerie Maeght for eight breaches of anti-money laundering obligations, marking a significant escalation in regulatory enforcement. Lawyer Olivier de Baecque, a specialist in art market law, stated that the decision sends a strong signal to the market. The fine, representing about one-third to half of the gallery's annual profits, was made public to underscore the severity of the violations. Key failures included a transaction over €100,000 involving a Turkish buyer using a company with no connection to art, and a €700,000 transaction where a simple open-source check would have revealed the buyer's criminal record. De Baecque noted that while only four dealers have been sanctioned in two and a half years, the pace of controls is intensifying. He emphasized that professionals must conduct annual risk assessments, maintain client identification and records for five years, and report suspicious transactions to Tracfin. The ruling highlights the art market's vulnerability due to international flows, intermediaries, subjective valuations, and a culture of confidentiality, though De Baecque cautioned against viewing the sector as inherently fraudulent, noting most are very small businesses with limited resources.
