Brazil Establishes National Arts Policy Recognizing Artistic Expression as Fundamental Right

Brazil has implemented a landmark National Arts Policy through Presidential Decree No. 12,916, signed by President Luiz Inácio Lula da Silva and published in the Official Gazette on March 31, 2026. This comprehensive framework establishes unprecedented guidelines for supporting, protecting, and disseminating artistic expression across the nation. The policy emerged from over a decade of collaborative efforts involving the National Arts Foundation, the Ministry of Culture, and various artistic sector representatives. Under the new regulations, artistic practice is formally acknowledged as a fundamental population right, integrating cultural rights outlined in Brazil's Constitution. The policy encompasses multiple artistic disciplines including visual arts, cinema, dance, theater, music, literature, and circus arts, committing the state to promote, safeguard, and expand access to artistic production nationwide. Key principles emphasize cultural diversity, creative freedom, inclusion, accessibility, sustainability, and climate justice. The framework adopts a systematic approach organizing the sector through creation, dissemination, education, research, preservation, and internationalization phases. It introduces significant changes to arts funding models by encouraging coordination between federal, state, and municipal governments to decentralize resources and strengthen regional initiatives. New investment mechanisms include public-private partnerships, hybrid funds, and creative economy projects to enhance sustainability for artists and institutions. Development of the policy began in 2015 through a collective process involving public debates, seminars, research, and consultations with cultural sectors, led by Minister Margareth Menezes and Funarte President Maria Marighella. This institutional instrument positions culture as a strategic dimension for national development, placing artistic activity at the center of public policy with goals of greater inclusion, diversity, and cultural sector strengthening.
