Judge Nandra Martins da Silva Machado of the 5th Public Treasury Court prohibited further eviction actions and incursions by the Metropolitan Civil Guard, citing the theater's complex structure of 15 interconnected maritime containers, glass walls, acoustic covering, lighting, and artistic-cultural collection. The decision follows a violent invasion by the Guard on Tuesday, 19, where artists were forcibly removed using pepper spray and physical restraint. Founded in 2017, the theater has served as a cultural refuge in central São Paulo, providing humanitarian aid during the pandemic in 2020 by distributing 40,000 meals and acting as a logistics point for Médecins Sans Frontières. It also hosted the 2019 exhibition 'O Fluxo Expõe – A Arte da Cracolândia' featuring artists like Clayton Dentinho and Ed Peixoto. The city administration claims it aims to revitalize the area and build social housing, having offered three alternative legalized areas which were allegedly not accepted. Funarte president Maria Marighella has intervened, sending an official letter to Mayor Ricardo Nunes to explore swapping the contested land for federal property.
