Moses Pelham and Kraftwerk's 27-Year Sample Dispute Could Reshape German Hip-Hop

A 27-year legal battle between German rapper Moses Pelham and electronic band Kraftwerk over a brief sample may redefine artistic freedom in hip-hop and rap, driven by a recent EU directive on pastiche. The dispute began in 1999 when Pelham used a two-second sample from Kraftwerk's 'Metall auf Metall' without permission. Pelham, a hip-hop mogul and producer known for launching Xavier Naidoo's solo debut, references the ongoing litigation in his 2024 track 'Sound Good' with the line: 'Ich hab Rechtsstreitigkeiten, die sind älter als du.' The case has reached German and European courts, centering on whether sampling constitutes copyright infringement or is protected as pastiche under EU law. A 2021 EU directive on copyright in the digital single market includes an exception for pastiche, which could allow sampling without permission if it imitates or references another work. The German Federal Court of Justice has referred questions to the European Court of Justice, seeking clarity on the scope of the pastiche exception.
