Lucio Fontana's 'Delfino' Must Return to Italy After Legal Battle

Italy's Council of State has ruled that Lucio Fontana's ceramic sculpture 'Delfino' must be returned to the swimming pool of the Sporting Club in Monza, ending a decade-long legal dispute. The work, commissioned by the Tagliabue oil magnates for their villa, was removed from the club and taken to Innsbruck, Austria, where it was stored at the InnAuction auction house and slated for sale at a minimum price of €500,000. The ruling affirms the 2017 order by the Superintendence of Archaeology, Fine Arts and Landscape of Monza, which argued that the sculpture and the pool—designed by rationalist urbanist Giulio Minoletti and inaugurated in 1951—form an inseparable stylistic and structural whole. The court emphasized that the ensemble represents the patronage characteristic of post-war industrialists and reflects the interconnections between political, industrial, and entertainment sectors during Italy's reconstruction. The Sporting Club's real estate company had contested the order, but both the Regional Administrative Court and the Council of State upheld the Superintendence's decision. The sculpture, a red-brown glazed ceramic piece from Albisola, must now be reinstalled at the poolside in Monza.
