Italian court rules cultural heritage images cannot be used without authorization

The Court of Florence has issued a landmark ruling declaring that the image of cultural heritage works is protected as an expression of citizens' collective identity under the Italian Constitution. The case was brought by the Galleria dell'Accademia against a major publishing house that used Michelangelo's David on a magazine cover for advertising without permission and altered the image by superimposing it on a model via lenticular printing. The court found both patrimonial damage (€20,000 for unpaid usage fee) and non-patrimonial damage (€30,000) for debasing the symbolic and identity value of the artwork. The ruling establishes a general principle beyond the single case, as stated by Galleria director Cecilie Hollberg. Culture Minister Gennaro Sangiuliano welcomed the decision but focused on paid commercial use versus free educational use, though his comments appear to conflict with Decree 161 of April 11, which sets fees for scientific publications. The ruling positions Italy at the forefront of cultural heritage protection.
